FICA Tax Refund

On February 22, 2011, Maimonides Medical Center (MMC) perfected its claims with the IRS on behalf of its residents and fellows for FICA taxes withheld on stipends paid between January 1, 1995 and April 1, 2005. Residents and fellows who timely submitted signed consent forms to opt in were included in the submission. MMC began receiving checks from the IRS by quarter in October 2012.
The first checks will go out May 3, 2013. The checks include the portion of FICA taxes refunded by the IRS for the applicable years plus interest.
Form W-2c Corrected Wage and Tax Statements for each applicable calendar year will also be included with the check. The amounts reflecting previously paid taxes are not taxable to the resident/fellow. The Corrected Form W-2c’s are for the residents’/fellows’ records.
The interest included in the check is taxable in the year received. If interest is
$600 or more, MMC will send residents/fellows a form 1099-INT in January 2014.
The IRS has not refunded MMC’s claim for the 4th quarter of 2002. If the period of residency/fellowship at MMC included the 4th quarter of 2002, affected residents/fellows will receive a second check once the IRS completes processing that quarter.
